Job description

Job Purpose :

This role is responsible to enforce Swatch Group’s IP rights (Trademark, Design, and Copyright) mainly online, including platforms such as Marketplace, social media, e-commerce website.

The position require offline enforcement knowledge as well (online to offline action, customs seizures). You will need to work with internal and external stockholders (Customs, Government authority, Law firm) to initiate and follow up legal actions against counterfeiting activities, IP infringement matters, and Unfair competition.

General Intellectual Property (IP) rights Enforcement / Brand Protection

  • Online monitoring of platforms such as Marketplace, social media, e-commerce website or any other digital venues regarding IP Infringements. Online Investigation on important targets ;
  • Work with external anti-counterfeits agencies or law firms to initiate and follow up on legal actions (civil, criminal, and administrative) against any kind of IP infringement ;
  • Negotiate and coordinate with the marketplaces, e-commerce platforms/ social media operators / Search engines to implement and improve measures to enforce Swatch Group's IP rights (Trademark, Design, and Copyright);
  • Being able to highlight local specificities regarding the legal framework of Intellectual Property Law and procedural rules.

Tackle Counterfeit products

  • Represent the company toward government authorities in matters related to anti-counterfeits;
  • Work with external lawyer, customs, government authorities on counterfeit related litigation.

Tackle Trademark and Design infringement issues

  • Assist HQ trademark team in important trademark and design related disputes.

Tackle Copyright issues

  • Identify and enforce Copyright rights on online platforms. Such as unauthorized use copyright pictures;
  • Collaborate with Sale and Marketing to identify unauthorized seller using our assets.

Identify Unfair Practices

  • Identification of Unfair practices (Unfair Competition Law).

Profile

Requirements:

  • Bachelor or Master Degree in Law
  • Fluent verbal and writing English, Cantonese and Mandarin
  • 3-5 years working experience in the IP enforcement and/or brand protection area at law firms, multinational companies.
  • Good knowledge about the Hong Kong IP laws as well as the Internet technical infrastructure and communication tools (social networks, mobile apps, etc.)
  • Good analytical and observation skills
  • Positive attitude, solution oriented, and Assertiveness and Customer care oriented
  • Autonomous, flexible, and real team player
  • Proficiency in MS Office (Professional), Excel PowerBI etc.
  • Knowledge about Internet / Information Law and Unfair competition Law is a plus
  • Knowledge in Forensic science or IT a plus
  • Previous experience in the watch industry of fashion industry is a plus
